SMS / Text Messaging Terms and Conditions

These SMS / Text Messaging Terms and Conditions ("Terms") govern your participation in the Application-to-Person (A2P) text messaging program operated by NWA Headlight Restoration ("NWA Headlight Restoration," "we," "us," or "our"). By checking a consent box on our Website at https://nwaheadlightrestoration.com and providing your mobile phone number, you agree to these Terms. If you do not agree, please do not opt in to receive text messages from us.

1. The Program

Our SMS program allows customers to receive text messages related to headlight restoration services, including appointment scheduling and confirmations, quote follow-ups, service updates, and - for those who separately opt in - marketing and promotional offers. Consent is collected through two distinct checkboxes on our forms:

● Non-marketing (transactional) messages, covering appointment scheduling, confirmations, and service-related updates tied to a request you've made.

● Marketing and promotional messages, covering special offers, discounts, and new product or service updates.

You may opt in to either category independently. Opting in to one category does not automatically enroll you in the other.

2. Consent and Eligibility

● You must be the account holder or authorized user of the mobile telephone number you provide.

● You must be at least 18 years of age to opt in to this program.

● By opting in, you represent that you have the authority to consent to receive text messages at the number provided.

Consent is not a condition of purchase. You are never required to opt in to text messaging in order to purchase or receive any goods or services from us.

3. Message Frequency and Fees

Message frequency varies depending on your interactions with us, appointment activity, and the message categories you've opted into. Message and data rates may apply, as determined by your wireless carrier. You are responsible for any fees charged by your mobile carrier as a result of receiving messages from us. We do not charge for text messages sent under this program.

4. Opt-Out (Cancellation)

You may cancel the SMS program, or any category of messages, at any time. Text "STOP" to any message you receive from us. After doing so, we will send you a one-time confirmation text message that you have been unsubscribed, and you will no longer receive messages from us unless you opt in again. If you have any questions, text "HELP" or contact us using the information in Section 10 below.

Carriers, including AT&T, T-Mobile, Verizon, and others, are not liable for delayed or undelivered messages.

5. Supported Carriers

Our SMS program is intended to work across major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Coverage and message delivery may vary based on your carrier, device, and service plan.

6. No Warranty on Message Delivery

Delivery of SMS messages is not guaranteed. We are not liable for delayed or undelivered messages, or for messages that are lost, altered, or misdirected due to carrier network issues, device settings, or other factors outside our control.

7. Privacy

Information collected in connection with this SMS program is handled in accordance with our Privacy Policy, available at https://nwaheadlightrestoration.com. Mobile opt-in data and consent are not shared with third parties for their own marketing purposes.

8. Changes to the Program or These Terms

We reserve the right to modify or discontinue the SMS program, in whole or in part, at any time, with or without notice. We may also update these Terms periodically; changes are effective when posted, and continued participation in the program after changes are posted constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.

9. Disclaimer of Liability

To the fullest extent permitted by law, we disclaim liability for any damages arising from your use of, or inability to use, the SMS program, including but not limited to delayed, undelivered, or misdirected messages, and unauthorized access to your mobile device or account.

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict of law principles, and applicable U.S. federal law, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines for SMS messaging.
